BIDDER CONTRACT: This BIDDER CONTRACT entered into between the Bidder whose name isregistered and shall govern this auction and he/she agrees with them. Additional terms may be posted or announced from the auction block which are just as binding as the below terms. FULL PAYMENT: All items must be paid for in full before Bidder leaves the premises. Nothing may be removed until it is settled for. Payment for purchases must be made by cash or cashier´s check or by personal check or business check of announced by The Auctioneer. Letters of Credit or guarantee must be for this auction only, along with proof of identity. All sales are subject to State Sales Tax laws. A buyer premium of 10% will be added to the successful bid price and is due as part of the total purchase price. Bidder agrees not to stop payment on checks or disallow a bank draft and is responsible for any expenses due to collection of bad check. In the event of non-payment of bad-check, The Auctioneers reserve the right to repossess, at any time, at your location, the merchandise involved.

WARRANTY: ALL ITEMS ARE SOLD AS IS, WHERE IS, WITHOUT GUARANTEE OF ANY KIND. The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Owner (or his agents or officers) or the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty,either expressed or implied, Bidder agrees to inspect the items they are bidding on and to satisfy themselves as to the proper name, age, and condition of the item.I, the Bidder, have examined this merchandise and except it in, as is condition.

DISPUTES: The Auctioneer shall designate the winning bidder after each item is auctioned. If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding. The Auctioneers´ designation of a Buyer shall be final. Failure to Comply: If successful bidder, fails to comply with written agreement or payment as required, the successful bidder shall be liable for any losses or damages occurred to seller, including but not limited to deficiency in selling price,attorney fees, or any other damages they may occure as a result of noncompliance by bidder.

ATTORNEY FEES: In an Action arising out of this agreement, the prevailing party shall be intitled to reasonable attorney fees and costs.

BUYER´S RESPONSIBILITY: After a Bidder has won the bid with his/her high bid; they have become the new owners of the item, even though they may not have paid for the item yet. The item(s) becomes the full and sole responsibility of the Buyer at this point, and Buyer assumes all risk of loss and damage. Buyers should guard their items accordingly. INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by the Bidder or his agent, and further agrees to hold the Auctioneers harmless form any personal injury to himself or his agents and any property damage incurred on auction premises.

AGENTS ONLY: The Auctioneers are acting as the Owners Agents only.

BIDDING: Bidding is open to the public, auction staff and auctioneer may bid on an item if they desire.

RESERVE: All item are sold with reserve unless stated otherwise. If reserve item does not meet set price item may be passed or price may be confirmed by seller. 13% BUYERS PREMIUM: A 13% buyers premium added to all bids and included in total sale price.W/ CASH OR CHECK. 13% W/ CREDIT/DEBIT CARDS.

Sales tax applies unless you have tax exempt number. 

 

WRITTEN MATERIAL: Any written material supplied to you should be used as a guide only. Items have been identified and described based on information available to us, but may not be accurate.

PAYMENT: Payment must be made in full at sale conclusion.

ABSENTEE BIDDERS: Auctioneer will bid or have someone bid on behalf of absentee bidder. Credit card number must be left with auctioneer. 

 

MOTORIZED ITEMS: Purchaser agrees to check out the mechanical operation of items(s) purchased before leaving sale site. Purchaser understands that Auctioneer has not driven or operated any of the equipment being sold and purchaser is buying as is and accepts all liability for the operation of item(s) purchased and agrees to hold Auctioneer harmless for claim resulting from use of item(s)purchased.

JEWELRY: Jewelry should be inspected by all purchasers. Auctioneer makes no warranties as to clarity, sizes, gold quantities, as to being synthetic, man made, or natural stones period. Satisfy yourself to value, no written or oral statement represents value. Auctioneer reserves the right to sell merchandise in any order they deem necessary. Items in catalog may be sold as singles, groups, ect. Announcements made at the auction supersede all printed material. All items are sold with reserve unless announced differently. Some items, the sale price, may have to be confirmed by owner. If buyer buys items with titles, they will be mailed to you. Additional terms that apply are available at check in counter. Payments made by check ? title will be held until check clears.

GUNS: FFL LAWS APPLY. All Gun sales are subject to background approval.

Additional fee is required for the background check.

ADDITIONAL TERMS FOR REAL ESTATE: 10% down day of sale, required in the form of cash, cashiers check or certified funds. Balance due within 30 days at closing. 10% Buyers Premium will be added to the final bid price and included in the total purchase price. All property to be sold “as-is, where-as”, with any and all faults and no implied warranty by seller or Auctioneer. All information and dimensions were derived from sources believed to be correct but are not guaranteed. Buyers shall rely on their own information, judgement and inspection of the property and records, including, but not limited to, all documents recorded in the County where the property is located. All announcements from the auction block will take precedence over any previously printed material or any other oral statements made.Conduct of the auction and increments of bidding are the direction of the Auctioneer.The selling price of the property shall be determined by competitive bidding at the auction. Sellers reserve the right to withdraw the property without notice.On homes that were built before 1978, Buyer will have 10 days prior to the auction to conduct a risk assessment or inspection for the presence of lead based paint and/or lead based paint hazards as part of sale, buyer will be required to sign alead based paint inspection waiver as part of sales contract.Purchasers will be required to sign a specific performance contract. At request of bidder, they may review contract before sale. On Real Estate auctions,Jeff Dobson & Associates,Inc. acts as a sellers agent. Bidding increments are at the discretion of the auctioneer. Closings will be conducted by Seller’s appointed closing agent. Real Estate taxes are generally pro-rated at closing, but may vary from sale to sale. Every sale is unique and special terms may apply.
